Falcon File Transfer (“fft”) and falconfft.com · Effective October 21, 2026

This policy explains what information Makai Systems LLC (“Makai”, “we”, “us”), of Los Angeles, California, collects through the falconfft.com website and the Falcon File Transfer (“fft”) software, and what we do with it. It also covers information you give us when you ask for early access, license or buy fft, or contact us.

In short

  • Your files never come to us. fft sends data directly between computers you run, encrypted end to end. Makai has no server in that path.
  • fft has no telemetry. It doesn’t report usage, performance or system information to us.
  • License checks happen offline, on your machine.
  • The website uses analytics cookies (Google Analytics, with consent where the law requires it), plus cookieless Cloudflare analytics.
  • We keep what you send us (name, email, company, country) to license and support you, and we check names against U.S. government restricted-party lists because U.S. export law requires it.
  • We don’t sell your personal information.

1. The fft software

Your files and transfers. File contents, file names and transfer data go directly between the sending and receiving computers, encrypted end to end. Makai never receives them.

No telemetry. fft doesn’t send usage statistics, performance data, crash reports or information about your system to Makai.

License checks. fft verifies its license offline, on your computer, and makes no network call to do so. If you ask for a license bound to a specific machine (for example an air-gapped host), you send us an identifier that fft generates for that machine, and we use it only to issue that license. If your administrator turns on optional online license checks, fft downloads a list from us; it sends nothing about you.

Connecting two computers. To connect, the two computers need to exchange their network addresses (IP addresses and ports):

  • By default, fft exchanges them through a public peer-to-peer network run by independent third parties. The addresses are encrypted, so other participants can’t read them. As with any internet connection, the participants your computer talks to can see its public IP address. To keep fft off this network entirely, run both computers with --no-signal and connect by address.
  • Optional relay. Only if you turn it on with --signal-server, fft sends the addresses and a temporary connection code to a relay service Makai operates. The relay keeps them for up to 10 minutes so the two computers can find each other, then deletes them.

Reports and logs. fft can write transfer reports to a folder on your computer. File names and host IP addresses are redacted by default. Reports stay on your computer unless you choose to send them to us, for example for support.

2. The falconfft.com website

Hosting. Cloudflare hosts the site and processes the standard information every web request carries (IP address, browser type, requested page, time) to deliver and protect it.

Analytics. We use:

  • Google Analytics 4, which sets cookies and collects information such as pages viewed, how you reached the site, device and browser type, and approximate location derived from your IP address. Google processes this under its own privacy policy (policies.google.com/privacy). If you’re in the EU, EEA, UK or Switzerland, we ask first, and Google Analytics loads only if you accept. Anyone can change their choice with “Cookie settings” at the bottom of the home page; the choice is stored in your browser, and declining deletes the Google Analytics cookies. You can also opt out with Google’s browser add-on (tools.google.com/dlpage/gaoptout) or by blocking cookies.
  • Cloudflare Web Analytics, which counts visits without cookies.

We use analytics only to understand how the site is used. We don’t use them for advertising.

Do Not Track. The site doesn’t currently respond to browser Do Not Track signals.

The site has no forms. Early-access requests and questions come to us by email.

3. Information you give us

  • Email and conversations: your name, email address, company, and whatever you write to us. Our email is hosted by Google Workspace.
  • Licensing: your name, email address, company, country, the license’s term and identifier, and a machine identifier if you ask for a machine-bound license.
  • Export-control screening: before we issue a license, we check your name and company against the U.S. government’s Consolidated Screening List, using the U.S. Department of Commerce’s trade.gov service, and keep a record of the check. U.S. export law requires this for encryption software.
  • Agreements: evaluation, reseller or purchase agreements you sign with us.
  • Payments: if you pay online, our payment processor (for example Stripe) handles your card details. We don’t see or store full card numbers.

4. How we use information

We use it to:

  • provide fft, issue and manage licenses, and give support;
  • reply to you and send information about your license or account;
  • comply with the law, including export controls, sanctions, tax and record-keeping;
  • understand and improve the website;
  • prevent fraud, abuse and license misuse, and enforce our agreements.

5. Who we share it with

  • Service providers that work for us: Google (email and analytics), Cloudflare (website hosting and the optional relay), our payment processor, and our accountants and lawyers.
  • The U.S. government’s screening service: the names we check, as described above.
  • Resellers: if you buy through a reseller, the information needed to license you.
  • Legal requirements: when the law, a court or a government authority requires it, or to protect our rights or someone’s safety.
  • Business transfers: a buyer or successor if Makai or its business is sold or merged.

We don’t sell personal information, and we don’t share it for targeted advertising.

6. How long we keep it

  • Licensing and export-screening records: at least 5 years after the license ends, as U.S. export rules require.
  • Email and business correspondence: as long as we have a relationship with you, and afterwards as long as needed for legal, tax or accounting reasons.
  • Website analytics: according to our Google Analytics retention setting.
  • Relay entries: up to 10 minutes.

7. Security

We protect information with encryption in transit, access limited to the people who need it, and reputable service providers. No system is perfectly secure, so we can’t guarantee absolute security.

8. Your choices and rights

Anyone, wherever they live, can ask us to see, correct or delete the personal information we hold about them, or to stop using it for a particular purpose. Email us at the address below. We’ll reply within 30 days. Some records, such as export-screening records, must be kept for the period the law requires.

Visitors in the EU, UK and Switzerland. We process personal information to perform our agreements with you, to meet legal obligations (such as export controls), for our legitimate interests in running and improving our business and website, and with your consent where the law requires it. You can access, correct, delete, restrict, object to the processing of, or receive a copy of your personal information, withdraw consent at any time, and complain to your local data protection authority. We are based in the United States, and your information is processed there.

California residents. You may ask what personal information we’ve collected about you and ask us to delete it, as above. We don’t sell or share personal information as California law defines those terms.

9. Children

fft and the website are for businesses and professionals. They aren’t directed to children under 16, and we don’t knowingly collect personal information from them.

10. Changes

We’ll post any changes on this page and update the effective date. If a change is significant, we’ll also tell licensees by email.
